As I said I don’t have an opinion on whether this should be allowed or not. But if it should be, the solution is to work with Jolla to fix the validator. At least in the explanation above, you’re explicitly and intentionally working around a safety feature. This is generally considered malicious behaviour. And honestly, that should be enough to kick an app off the store imo.
It does not matter that the rules might not make the most sense to you, they’re still the rules.
Just to make sure this discussion stays on track: This thread is about asking Jolla whether they would allow an app to bundle a third-party executable - either in a exception of or, better, as an update to the current Harbour rules.
Even though it was now brought up once or twice, the intention is not to circumvent those rules, but to discuss evolving them - for the benefit of the platform. To my understanding, that is the point of this entire category.

Understood. I don’t want to digress too much into sandboxing here, but to my (limited) understanding firejail is in the process of adding initial support for Landlock. That would go a long way to further restrict apps to their working directories and give them no chance to touch any libexec directories they have no business in.
Caveat: I think Landlock is not available on the kernel shipping with Jolla Phone 2026
