Looks like this is a duplicate of Cannot delete very first (at the very bottom) video / image / screenshot in the Gallery App which is marked “tracked”.
(There’s another duplicate in [4.4.0.64] Unable to delete the last row (oldest) of Photo / Video in gallery)
